Matthew R. "Matt" Davies was one of three defendants indicted by a Stockton, California, grand jury in July 2012 for cultivating marijuana for sale to licensed patients in California,[1] whose use is legal under the California Compassionate Care Act of 1996.
The investigation began following a September 22, 2011 traffic stop of Davies, where he informed California Highway Patrol officer that he was responding to a burglar alarm at his warehouse, where marijuana was stored.[2]
A federal search warrant was obtained and executed on the warehouse in Stockton, CA October 18, 2011,[3] as well as other locations related to the marijuana dispensary.[1] Davies' medical marijuana dispensary had accountants, lawyers, managers, and a staff of 75. He paid state sales tax and had state and local business permits.[4]
The case raises important questions of the conflict between state and federal laws,[5] since the cultivation and production of marijuana is legal in 18 states, and legal for recreational use in two.[6]
Davies and the other indictees face a maximum of 40 years in prison if convicted.[1]
