Honduras Public Prosecutor's Office (Ministerio Público de Honduras) is a Public and constitutional organization. It was established on 6 January 1994 through Legislative Decree No. 228-93. It has its headquarters in city of Tegucigalpa M.D.C. which is the capital of the republic of Honduras. It is an independent, autonomous, and unpolitical organization. It is not under either the Supreme Court or the Office of the Attorney General. The Public Prosecutor General is appointed by the National Congress.

Its main functions are the prosecution of all types of crimes, to ensure that every citizen must follow the Constitution and the law of the land, and to represent, to defend and to protect the general interest of society. All the Republic of Honduras is the jurisdiction of the Public Prosecutor’s Office. Every citizen have access to this office without any restriction of age, sex, religion etc.

Historical background

Before 1994 the public entity that represents to the state, was part of the Supreme Court of Justice of Honduras. The fiscal agents were learned people or civilians that were nominated by purely political point of view. They had to represent in front of the competent cases to the judicial device. The government of the Graduate Rafael Leonardo Alleys, issued the "Law of the Public Ministry" by the National Congress of Honduras. Appointment of new unpolitical fiscal agents, use of new policy of investigation like DIC (Direction of Criminal Investigation) in place of the controversial DNI (National Direction of Investigation) and with the scientific branch(Forensic medicine) and modernization established more effective system of investigation and justice in Honduras.

Direction of the Public Ministry

The current general public prosecutor of the Honduran state, is the Lawyer Óscar Fernando Chinchilla Banegas, ex Magistrate of the Supreme Court of Justice. The Public prosecutor Attach is the Lawyer Rigoberto Cuéllar, ex minister of the Office of Natural Resources and Environment of Honduras. Both were elected on 31 August 2013.[1][2]

Forensic medicine

The forensic medicine(judicial medicine), is an important branch of the medicine that determines the origin of injuries of an injured. Medical specialists examines the cause of death by means of the examination of a corpse. Then they issue their opinion.

Inability

Public prosecutor office receives annually more than 50.000 cases to investigate. It has capacity to investigate only 5%. Remaining 95% cases are left without investigation. Because of this there is increase in crime.[3]

Expansion of contract killing

Because of the lack of resources and investigations by public prosecutor office, crime has increased exponentially. During the government of Rafael Alleys the assassin increase about 300%. During the government of Porfirio Lobo(2010-2014) 27 thousand people were murdered, which is equal to all the murders of 20th century in Honduras.
